Terms and Conditions
By applying for the Association Business Model Accelerator, you agree to the following Terms and Conditions.
- Eligibility Requirements
To be eligible for the McKinley Advisors (“McKinley”) Association Business Model Accelerator (“Program”), each participating organization must be a registered and active 501(c)(3) or 501(c)(6) nonprofit organization (or equivalent status under applicable law). Participating Organizations and their assigned representative will be collectively referred to as "Participant". - Registration and Payment
By submitting an application to attend the Program, the Participant acknowledges and agrees to be responsible for payment of all applicable registration fees. Participation in the Program is confirmed upon receipt of full payment of the registration fee. Registration includes up to two representatives; additional representatives may be added for a fee. Additions and substitutions of Participant representatives are subject to McKinley’s approval. All fees must be paid in full prior to the start date of the Program. - Cancellation and Refunds
Participants may cancel their registration by providing written notice to McKinley.- Cancellations received 60 or more days prior to the Program start date are eligible for a 100% refund.
- Cancellations received between 30 and 59 days prior to the Program start date are eligible for a 50% refund.
- Cancellations received fewer than 30 days before the Program start date are not eligible for a refund.
- Referrals and Incentives
Participants are encouraged to refer other organizations to apply for the Program. For each referred applicant who submits a complete application, both the referring organization (“Referrer”) and the referred organization (“Referee”) will receive a $500 discount applied to their respective registration fees. To qualify for the incentive, the Referee must list the Referrer’s organization name on their Program application at the time of submission, and the referral must be received prior to payment of registration fees. No refunds, rebates, or retroactive discounts will be issued for referrals submitted after payment has been received. McKinley Advisors reserves the right to verify eligibility and apply discounts at its discretion. - Publicity, Use of Name, and Likeness
Participants grant McKinley Advisors the right to list their organization’s name in promotional, marketing, and educational materials, including but not limited to the McKinley website, social media, and printed materials.
Participants also grant McKinley Advisors permission to photograph, record, and otherwise capture the image, likeness, and voice of their participating representatives during the Program. McKinley Advisors may use such photos, video, or audio recordings for promotional, educational, or informational purposes in any media now known or hereafter developed, without additional notice or compensation. Participants may contact McKinley Advisors in writing if they wish to opt out of having their likeness used in this manner. - Program Modifications
McKinley reserves the right to make changes to Program content, schedule, faculty, or delivery format (e.g., in-person to virtual) without liability, provided the overall intent and integrity of the Program is maintained. - Force Majeure
McKinley shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including any act of God or a public enemy or terrorist, act of any military, civil or regulatory authority, change in any law or regulation, fire, flood, earthquake, storm or other like event, disruption or outage of communications, power or other utility, epidemic or disease, or any other cause, whether similar or dissimilar to any of the foregoing, which could not have been prevented with reasonable care (each, a "Force Majeure Event"). Within 24 hours of the occurrence of a Force Majeure Event, McKinley shall notify Participants of the occurrence by sending an e-mail message. - Confidentiality
During the duration of the Program, Participants may gain access to confidential and/or proprietary information and trade secrets of other Participants or McKinley, including information which has been so identified, or information which by the nature of the circumstances surrounding the disclosure ought in good faith be treated as proprietary or confidential, including, but not limited to: activities of the Parties, business plans, strategic plans, financial information, marketing and communication strategy, client or lead data, and any other proprietary information (collectively, “Confidential Information”). The Parties agree to take all commercially reasonable security measures to protect Confidential Information and shall use such information solely for purposes of participating in the Program. - Intellectual Property
All Program materials developed by McKinley are the property of McKinley Advisors. Participants may not reproduce, distribute, or share Program materials without prior written permission. - Use of Generative AI
McKinley may use generative artificial intelligence (“AI”) tools and technology to assist in background research, document drafting, and other tasks. This technology enables McKinley to provide more efficient and cost-effective services, however it is never a substitute for the expertise and judgment of its consultants. McKinley will exercise professional judgment in using AI-generated content and ensure its accuracy and appropriateness for the work. McKinley exclusively utilizes paid, enterprise-level AI services with strict data privacy controls, and does not use free or public AI services that may retain or train on client data. All data processing complies with our confidentiality obligations and data protection policies. - Privacy Policy
McKinley is committed to safeguarding the privacy of our Program Participants. Please visit this link for the latest terms of the McKinley Privacy Policy.The purpose of this Privacy Policy is to inform you of our practices with regard to personal data we collect from or about you in connection with our research methodologies (“Research”) or through the provision of our services (the “Services”). By participating in the Program and agreeing to this policy, you consent to our collection, use, and disclosure of information in accordance with the terms of this policy. All staff members and McKinley affiliates who have access to data or personal information collected by McKinley are expected to uphold the McKinley Privacy Policy. - Compliance with Laws
Participants agree to comply with all applicable laws, statutes, regulations, and codes while participating in the Program. - Mutual Indemnification
Participants and McKinley shall each defend, indemnify and hold harmless the other Party against all liabilities, claims, suits, demands, damages, losses, judgments, costs, fines, penalties, interest, and expenses, including, without limitation, reasonable attorneys’ fees and costs, resulting from any acts, errors, omissions, or conduct of such Party or Party’s officers, directors, employees, agents, contractors, or other representatives in connection with the performance of any obligation under these Terms and Conditions, any material breach by such Party of any representation or warranty hereunder, or any other material breach by such Party. - Mutually Held Expectations on Discrimination, Harassment, and Intimidation
At McKinley, we are committed to building an environment that does not just welcome diversity, equity, and inclusion but also makes it a core value in our work. We ask our clients to join us in mutual agreement to uphold these values. To that end, we both agree that for the duration of the Program:- All representatives of Participants and McKinley will treat each other with respect and dignity;
- Harassing, discriminatory, or derogatory behavior or language toward any individual as a party to or involved in the Program is unacceptable and must be reported immediately to the lead contact for the Participant and the lead representative for McKinley Advisors;
- We will work together to immediately address the behavior of any individual in conflict with these values, which may lead to actions ranging from verbal feedback or reprimand to reduction in involvement or removal from the Program.
McKinley reserves the right to remove or deny continued participation to any Participant whose conduct violates these expectations or otherwise disrupts the learning environment, without refund. - Governing Law
This Agreement shall be governed by the laws of the District of Columbia. Any claim or cause of action arising out of or connected with this Agreement shall be brought exclusively in either the local or federal courts of the District of Columbia, and the parties hereto consent to submit to the personal jurisdiction of such courts, and waive all objections to such jurisdiction and venue. - Agreement
These Terms and Conditions constitute the entire agreement between McKinley and the Participant with respect to the Program and supersede all prior agreements, understandings, or representations.
